Gizlilik Politikası ve Kişisel Verilerin Korunması Aydınlatma Metni

Atölye Afife (AFİFE SANATSAL FAALİYETLER VE TİCARET LİMİTED ŞİRKETİ) olarak, atolyeafife.com web sitesini ziyaret eden ve bizimle iletişime geçen kişilerin gizliliğine önem veriyoruz. Bu metin, 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") kapsamında, kişisel verilerinizin nasıl toplandığını, hangi amaçlarla işlendiğini, kimlere aktarılabileceğini, toplama yöntemini ve hukuki sebebini ve KVKK kapsamındaki haklarınızı açıklamak amacıyla aydınlatma yükümlülüğümüz çerçevesinde hazırlanmıştır.

2. Hangi Kişisel Verileri Topluyoruz?

Site üzerinden veya bizimle iletişime geçtiğinizde aşağıdaki kişisel verilerinizi topluyoruz:

- Ad ve soyad
- Telefon numarası
- E-posta adresi
- İlgilendiğiniz atölye programı

Bu veriler yalnızca sizin tarafınızdan, iletişim formu, telefon, e-posta veya mesaj yoluyla bize doğrudan iletildiğinde toplanır.

3. Kişisel Verilerinizi Hangi Amaçlarla İşliyoruz?

Topladığımız kişisel verileri şu amaçlarla işliyoruz:

- Talep ettiğiniz atölye programları hakkında bilgi vermek
- Ön kayıt ve kayıt süreçlerinizi yürütmek
- Randevu ve ön görüşme taleplerinizi planlamak
- Sorularınızı yanıtlamak ve sizinle iletişim kurmak
- Yasal yükümlülüklerimizi yerine getirmek

4. Kişisel Veri Toplamanın Yöntemi ve Hukuki Sebebi

Kişisel verileriniz; Site üzerindeki iletişim formu, e-posta, telefon veya mesajlaşma kanalları aracılığıyla, tamamen veya kısmen otomatik ya da otomatik olmayan yollarla toplanır.

Verileriniz, KVKK'nın 5. maddesi uyarınca; bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması (madde 5/2-c), veri sorumlusunun meşru menfaatleri için işlemenin zorunlu olması (madde 5/2-f) ve gerektiğinde açık rızanız (madde 5/1) hukuki sebeplerine dayanılarak işlenir.

5. Kişisel Verilerin Kimlere ve Hangi Amaçla Aktarılabileceği

Kişisel verileriniz, yukarıda belirtilen amaçların gerçekleştirilmesi için gerekli olduğu ölçüde ve yalnızca yasal sınırlar çerçevesinde işlenir. Verileriniz, açık rızanız olmaksızın veya yasal bir zorunluluk bulunmaksızın üçüncü kişilerle paylaşılmaz.

Verilerinizin yurt dışına aktarılması, ancak KVKK'nın 9. maddesinde öngörülen şartların (Kurul tarafından verilen yeterlilik kararının bulunması veya maddede sayılan uygun güvencelerden birinin sağlanması) varlığı hâlinde gerçekleştirilir.

6. Kişisel Verilerin Saklanma Süresi

Kişisel verileriniz, işlendikleri amaç için gerekli olan süre boyunca ve ilgili mevzuatta öngörülen saklama süreleri kadar muhafaza edilir. Bu sürelerin sona ermesinin ardından verileriniz silinir, yok edilir veya anonim hale getirilir.

7. Verilerin Güvenliği

Kişisel verilerinizin hukuka aykırı olarak işlenmesini ve verilerinize yetkisiz erişimi önlemek, verilerinizin muhafazasını sağlamak amacıyla uygun güvenlik düzeyini temin etmeye yönelik gerekli teknik ve idari tedbirleri alıyoruz.

8. KVKK Kapsamındaki Haklarınız

KVKK'nın 11. maddesi uyarınca aşağıdaki haklara sahipsiniz:

- Kişisel verilerinizin işlenip işlenmediğini öğrenme
- İşlenmişse buna ilişkin bilgi talep etme
- İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme
- Yurt içinde veya yurt dışında verilerin aktarıldığı üçüncü kişileri bilme
- Eksik veya yanlış işlenmiş verilerin düzeltilmesini isteme
- KVKK'nın 7. maddesindeki şartlar çerçevesinde verilerin silinmesini veya yok edilmesini isteme
- Düzeltme, silme ve yok etme işlemlerinin, verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme
- İşlenen verilerin münhasıran otomatik sistemlerle analiz edilmesi sonucu aleyhinize bir sonucun ortaya çıkmasına itiraz etme
- Verilerin kanuna aykırı işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme

9. Haklarınızı Nasıl Kullanabilirsiniz?

Yukarıda sayılan haklarınıza ilişkin taleplerinizi, yukarıda belirtilen adresimize yazılı olarak veya [iletişim e-posta adresi] üzerinden iletebilirsiniz. Talebiniz, niteliğine göre en kısa sürede ve en geç otuz gün içinde ücretsiz olarak sonuçlandırılır. Ancak işlemin ayrıca bir maliyet gerektirmesi hâlinde, Kişisel Verileri Koruma Kurulunca belirlenen tarifedeki ücret alınabilir.

10. Veri Sorumluları Sicili (VERBİS)

Atölye Afife, KVKK'nın 16. maddesi ve Kişisel Verileri Koruma Kurulu tarafından belirlenen kriterler çerçevesinde, Veri Sorumluları Siciline (VERBİS) kayıt yükümlülüğü bulunması hâlinde bu yükümlülüğünü yerine getirir.

11. Çerezler

Sitemiz temel işlevselliğini sağlamak amacıyla çerezler kullanabilir. Tarayıcı ayarlarınızdan çerez tercihlerinizi her zaman değiştirebilirsiniz.

- Providing information about the workshop programs you request
- Managing your pre-registration and registration processes
- Scheduling your appointment and preliminary interview requests
- Answering your questions and communicating with you
- Fulfilling our legal obligations

4. Method and Legal Grounds of Data Collection

Your personal data is collected through the contact form on the Site, by e-mail, phone, or messaging channels, by wholly or partly automated means or by non-automated means.

Your data is processed under Article 5 of the KVKK on the following legal grounds: where processing is directly related to the establishment or performance of a contract (Art. 5/2-c), where processing is necessary for our legitimate interests (Art. 5/2-f), and, where required, your explicit consent (Art. 5/1).

5. To Whom and For What Purpose Personal Data May Be Transferred

Your personal data is processed only to the extent necessary to achieve the purposes stated above and strictly within legal limits. Your data is not shared with third parties without your explicit consent or a legal obligation.

Any transfer of your data abroad takes place only where the conditions set out in Article 9 of the KVKK are met (the existence of an adequacy decision issued by the Board, or the provision of one of the appropriate safeguards listed in that Article).

6. Data Retention Period

Your personal data is retained for as long as necessary for the purposes for which it is processed and for the retention periods stipulated in the relevant legislation. Once these periods expire, your data is deleted, destroyed, or anonymized.

7. Data Security

We take the necessary technical and administrative measures to ensure an appropriate level of security, in order to prevent the unlawful processing of your personal data, to prevent unauthorized access to it, and to ensure its safekeeping.

8. Your Rights Under the KVKK

Under Article 11 of the KVKK, you have the following rights:

- To learn whether your personal data is being processed
- To request information if it has been processed
- To learn the purpose of processing and whether the data is used in accordance with that purpose
- To know the third parties to whom the data is transferred, domestically or abroad
- To request the correction of incomplete or inaccurately processed data
- To request the deletion or destruction of your data within the conditions set out in Article 7 of the KVKK
- To request that correction, deletion, and destruction operations be notified to third parties to whom the data has been transferred
- To object to a result arising against you as a consequence of the exclusively automated analysis of your processed data
- To claim compensation for damages arising from the unlawful processing of your data

9. How to Exercise Your Rights

You may submit your requests regarding the rights listed above in writing to our address stated above or via [contact e-mail address]. Your request will be concluded free of charge as soon as possible and within thirty days at the latest, depending on its nature. However, if the process requires an additional cost, the fee set in the tariff determined by the Personal Data Protection Board may be charged.

10. Data Controllers' Registry (VERBİS)

Where Atölye Afife is subject to the obligation to register with the Data Controllers' Registry (VERBİS) under Article 16 of the KVKK and the criteria set by the Personal Data Protection Board, it fulfils this obligation.
